Patents Services in the UAE
A Patent denotes a grant from the Government of a monopoly in respect of a new invention. It is a grant conferring on the patentee for a limited period, a monopolistic or exclusive right of making, selling or licensing the invention.
Rights of Patent
The rightful owner of the patent shall have the legal power to forbid third parties from carrying out any activities related to manufacturing, importing, offering for sale, selling or using the product or keeping it with a view to offering it for sale or use, whether the rights given to him are related to a product or a process. Also, he or his legal heirs shall have the right to obtain an additional Patent or for improvement, changes or an addition to the invention after it has been patented. The application for additional protection requires the same process of the original application.
The concerned department in the Ministry of Finance & Industry, shall carry out the necessary checking, and subsequently shall accept or reject the application. If accepted, the decision will be published in the Official Gazette, dependent on payment of the publication fees, and be open for the objection from the general public for a period of sixty (60) days thereafter. If no objection is being raised by any third party, then the patent will be registered accordingly. In case, the application is rejected, the applicant shall have the right to appeal to the Ministry of Information & Culture within sixty (60) days.
